Privacy Policy of NRKW ID App

Bay Cetology built and owns the NRKW ID mobile application. This page informs you of our policy regarding the collection, use and disclosure of personal information we receive from users of the App. Data concerning the user are collected to allow the owner to provide its service, comply with its legal obligations, respond to enforcement requests, protect its rights and interests along with those of its users or third parties, detect any malicious or fraudulent activity, and conduct analytics. By using the NRKW ID App, you agree to the collection and use of information in accordance with this policy and accept both our Terms & Conditions and our Privacy Policy. If you do not agree to our Terms & Conditions or this Privacy Policy, please do not use the NRKW ID App.    

Information Collection And User Authentication 

As of the date of the last Privacy Policy update, the user is not required to create an account to use the NRKW ID App. However, the user has the possibility to register with a name, a valid email address and a password in order to receive personalized push messages. All users having downloaded and used the App prior to this update will have been required to register. The registration process ensured the user was aware of our Terms & Conditions as well as our Privacy Policy, both available for reading prior to downloading the App and within the App itself. All users must be at least thirteen years old in order to register to the App. If the user is not thirteen years old yet, the user must require permission from a parent or a guardian in order to provide a name and an email address for registration. By registering, the user warrants that they are at least thirteen years old or have the permission from their parent or guardian to register and get access to the App. The personal information provided by the user is collected by Bay Cetology and stored for registration or identification purposes only, and will never be sold, traded or rented to third parties. You may send a request to access, edit or delete the personal information collected through registering to the App by contacting us by email.    

Device Permissions 

Permissions to access the user's device data are asked from the App user when the App is downloaded from the store and/or when a specific functionality is used, depending on the user's specific device. The user must grant the Permissions before the respective information can be accessed. The user can revoke the Permissions at any time through the Permissions’ settings within the App or through the settings of the device itself. Please note that the revoking of such Permissions might impact the proper functioning of the App. Device Permissions may include access to the Camera, Photo Library, Location and Storage. Complete details on each type of personal information collected are provided by specific explanation texts displayed prior to the data collection. The Permissions are required for specific functionality built in the App and we do not have access to any of the functionalities or data contained in the user’s device.   

Log Data 

Usage data called Log Data may be collected automatically by third parties in case of an error occurring while using the App. Log Data are also collected by a third party when using the App in order to provide us with analytics. The analytics’ purpose is to allow us to improve your experience with the NRKW ID App. Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the time and date the App is used, the moments it is opened and closed, the geo-location when the App is downloaded, the specific parts of the App being used and the amount of time spent using them. We, the owner of the App, will have access only to aggregated information, which is non-personal information.    

Security 

Measures are implemented to secure your personal information, to minimize the risks of damage, loss of information and unauthorized access or use of information. However, no method of transmission over the Internet or method of electronic storage is 100% secure and reliable. Therefore, it is not guaranteed and you cannot reasonably expect that the App and its related databases will be immune from any wrongdoings, malfunctions, unauthorized interceptions or access, or other kinds of abuse and misuse.    

Where Are The Data Processed 

In addition to the owner of the App, the user’s personal data are accessible to external parties. This App has been built through the service of the online software-building platform, AppMachine. Authentication and personal usage data are collected and processed by AppMachine, which is based in the Netherlands and therefore complies with the European legislation in terms of personal data processing (Privacy Policy), and its third parties. The owner, based in British Columbia, Canada, collects and processes authentication information and non-personal usage data. Depending on the user's location, data transfers will involve transferring the user's data to a country other than their own. External parties have access to your personal data only when it is essential for providing the service of the App and are obligated not to disclose or use the information for any other purpose. However, parties may disclose your personal data where they believe, in good faith, that it is necessary to comply with a court order, ongoing judicial proceeding, criminal or civil subpoena, or other legal process or request by law enforcement authorities in British Columbia or the Netherlands, or to exercise their legal rights or defend themselves against legal claims. Bay Cetology is not responsible or liable for the way personal data are being processed by AppMachine and its third parties.    

Retention time 

Personal data shall be processed and stored for as long as needed to perform the activities detailed in this Privacy Policy. Once the retention period expires, personal data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period. The owner may be allowed to retain personal data for a longer period whenever the user has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the owner may be obliged to retain personal data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.    

Changes To This Privacy Policy 

We reserve the right to update this Privacy Policy at any time. Your continued use of the App after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. If any material changes are made to this Privacy Policy, we will notify you by placing a prominent notice of the changes on the Bay Cetology website. It is strongly recommended to check this page periodically, referring to the date of the last update listed at the top.
